Thanks for shopping with Laemmle. We appreciate the fact that you enjoy and support great, independent cinema. We also want to make sure you have a rewarding experience on Laemmle.com whether you're at your computer, using your tablet or mobile device, or visiting one of our several theater locations.

As with any shopping experience, there are terms and conditions that apply to transactions with Laemmle. We’ll be as brief as our attorneys will allow. The main thing to remember is that by placing an order or making a purchase, you agree to the terms set forth below along with our Privacy Policy and Terms of Use.

Agreement

This Terms of Sale Agreement (this "Agreement") constitutes a binding legal contract between you and Laemmle Theatres, LLC (“Laemmle Theatres”) the owner and operator of the laemmle.com website (the "Site"). By ordering any product or service via the Site, you signify your acceptance of this Agreement, as it may be amended or supplemented from time to time. When you (a) purchase a movie ticket, (b) complete the member registration process, (c) use the customer rating and review service, (d) purchase merchandise, or (e) use any other service offered by laemmle.com, you agree to the Terms of Use and any and all applicable purchase policy terms, which are incorporated herein by reference. If you do not agree to the Terms of Use please do not use laemmle.com. Any terms and conditions proposed by you which are in addition to or which conflict with the Terms of Use are expressly rejected by laemmle.com.com and shall be of no force or effect. You represent that you have read and agree to be bound by the Terms of Use, including our purchase policy terms and our Privacy Policy located at http://www.laemmle.com/pages/privacy.

Orders & Taxes

You may place your order on our Site at any time (subject to any planned or unplanned periodic downtime) notice. With respect to taxes, no taxes are due in relation to gift cards purchased through the Site. The gift card holder will be charged applicable sales taxes when merchandise is purchased in a Laemmle Theatre and the gift card is used as tender. If other items are purchased from the Site that are subject to sales tax, Laemmle Theatres will make customers aware of the tax amount due at the point of purchase.

Pricing & Shipping

Prices offered on the Site are quoted in U.S. Dollars. Such prices do not include shipping and handling, expedited service, or sales taxes, if applicable, which will be added to your total invoice price. You are responsible for any shipping and handling charges and state and local sales or use taxes that may apply to your order. Click here to review our current shipping process and policies.

If the amount you pay for an item is obviously incorrect, regardless of whether it is an error in a price posted on this Site or otherwise communicated to you, then we reserve the right, at our sole discretion, to cancel your order and refund to you the amount that you paid. This policy will apply regardless of how the error occurred.

Movie Ticket Purchases

THERE ARE NO ONLINE REFUNDS OR EXCHANGES for movie ticket purchases.  Before purchasing your tickets we urge you to confirm the title, time and location of the movie you wish to see.

At the time of your order, an order will be placed for your tickets in the theater's ticketing system, reducing the number of seats available for the chosen show time. While this allows us to provide our customers with the clear benefit of guaranteed seats, it prevents us from reselling tickets in the event that you do not attend your chosen show time.

If you cannot attend a show time for which you have purchased tickets, you may contact the appropriate theater to inquire about a refunds. We strongly recommend that you contact the theater's management prior to your show time, as they generally may not issue refunds or provide exchanges after show time. Any refund or exchange is at the discretion of theater management and can only be conducted at the theater box office where the movie is playing. If a refund is available, the theater box office may only refund to you the ticket price, the Convenience Charge is non-refundable.

Merchandise Purchases

All sales of products are final.  In some cases, arrangements can be made to exchange apparel items for a different size. Return shipping is the responsibility of the purchaser. Defective CD’s or DVD’s may be exchanged for the exact same item only. No exceptions. Please contact store@laemmle.com to discuss your options. We do not offer rain-checks on out of stock items. In rare cases where stock is not sufficient to fulfill your order, we will notify you by email or telephone, cancel your order, and refund your money. Prices for products offered may change at any time, and we do not provide price protection or refunds in the event of a price reduction or promotional offering.

Disclaimer of Warranties

YOU HEREBY WAIVE ALL OTHER REMEDIES, WARRANTIES, GUARANTEES OR LIABILITIES, EXPRESS OR IMPLIED, ARISING BY LAW OR OTHERWISE, WHETHER OR NOT OCCASIONED BY THE NEGLIGENCE OF LAEMMLE THEATRES. You acknowledge by your use of laemmle theatres' products that your use of the products and any reliance upon them is at your sole risk, and that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with laemmle theatres' products. Laemmle theatres expressly disclaims all other warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, quality, performance, fitness for a particular purpose, and non-infringement. Some states do not allow limitations on implied warranties so these limitations may not apply to you. The warranties set forth herein give you specific legal rights and you may have other rights which vary from state to state. If an item has been purchased for consumer use as defined by 15 u.s.c. § 2301, any implied warranty or warranties shall expire on expiration of any express warranty.

Waiver and Limitation of Liability

Laemmle Theatres has priced its products upon the understanding, and you hereby acknowledge the understanding, that Laemmle Theatres WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY FORM OF CONSEQUENTIAL, INCIDENTAL, STATUTORY, PUNITIVE, EXEMPLARY OR INDIRECT DAMAGES OF WHATEVER KIND OR TYPE ARISING FROM ANY TYPE OF COMMERCIAL, BUSINESS, ENVIRONMENTAL, TORT, WARRANTY, CONTRACT, STRICT LIABILITY OR OTHER CAUSES ARISING DIRECTLY OR INDIRECTLY FROM OR IN CONNECTION WITH ANY PRODUCT AND/OR ITS USE, except consequential damages for any injury to a person in the case of products purchased for consumer use as defined by 15 us c. § 2301. Follow all instructions and heed all warnings accompanying any products associated with the site. Some products, including those with small pieces, may not be suitable for children and should be kept out of the reach of children. All tools used for construction of craft products must be used carefully and with adult supervision. You agree not to join in any lawsuit with another person or serve as a class representative of any class action lawsuit against Laemmle Theatres arising out of your purchase or use of products ordered via the site.In-Store Pickup and Return

Indemnification

YOU AGREE TO DEFEND, INDEMNIFY AND HOLD COMPLETELY HARMLESS LAEMMLE THEATRES FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, COSTS, AND EXPENSES, INCLUDING ATTORNEYS' FEES, ARISING FROM OR RELATED TO YOUR USE OF ANY ITEMS PURCHASED VIA THE SITE.
